To comply with US A2P 10DLC regulations, mobile carriers require specific documentation regarding how you collect and protect candidate data. 

Warning:

Avoiding Registration Rejection: Carriers are extremely strict regarding Privacy Policies and Terms & Conditions. Failure to include the exact elements listed below will result in your registration being rejected.

Part 1: Privacy Policy Requirements

Your privacy policy must clearly state how candidate mobile data is handled. Specifically, it must include language confirming that opt-in data is not shared with third parties for marketing purposes.

Required Language Example:

Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. 
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Key Checklist:

  • Disclose what data you collect and its purpose.
  • Explicitly state that mobile opt-in consent will not be shared or sold.

Tip:

If your corporate privacy policy is difficult to change, we recommend creating a dedicated "Messaging Privacy Policy" page specifically for your recruitment SMS program.

Part 2: Terms and Conditions

You must provide a link to a Terms and Conditions (T&Cs) page. This can be a standalone page or a section on your careers site.

Your T&Cs must include:

  • Program Name: e.g., "[Company Name] Recruitment Alerts".
  • Program Description: What will you be texting them about?
  • Message & Data Rates: A disclosure that "Message and data rates may apply".
  • Frequency: A statement that message frequency varies.
  • Opt-out Instructions: Explicit instructions to text STOP to unsubscribe (must be in bold).
  • Support Instructions: Instructions to text HELP or a link to a support email/page.
  • Carrier Disclaimer: The statement: "Carriers are not liable for delayed or undelivered messages."

Part 3: Compliant SMS Opt-in Example

When asking a candidate to opt-in (on a job application or talent form), the checkbox (or phone number entry) must be optional and include links to your policies.

Part 4: Sample Terms and Conditions Template

You may copy and adapt the following template for your organization:

Program Description: By opting in to [Company Name] Recruitment Alerts, you consent to receive text messages from our recruitment team regarding your job application, interview schedules, application status updates, and relevant career opportunities at [Company Name].

Message Frequency: Message frequency varies based on your application status and interaction with our recruitment process.

Pricing Disclosure: Message and data rates may apply.

Opt-Out Instructions: You may opt out of receiving these text messages at any time. To stop receiving text messages from us, simply reply STOP to any message we send. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us relating to this program.
